This Legal and Privacy Statement explains the terms on which we operate the site at www.greengas.co.uk, the services it offers and the way in which you may use it. These terms also set out what information we may collect about you through the site and how that information may be used.  By using the site you wholly accept these terms. If you do not agree to these terms, you are not permitted to use the site and should exit the site immediately. We may change these terms at any time, so you should check this page each time you use the site in case there are any changes.

The Green Gas Certification Scheme is operated by us, Renewable Energy Assurance Limited. We also operate the site. We are a company registered in England and Wales with company number 05720606 and our registered office is at 6 Spring House, Graphite Square, Vauxhall Walk, London SE11 5EE. Your Registration

You must be a member to participate in the scheme. If you wish to become a member, please contact us. You cannot become a member via the site. Membership is subject to the Scheme Rules, a copy of which will be provided to you at registration and upon request (and which are also available on the website).  Upon becoming a member, we will register you on the scheme’s system and give you a secure account and password. This can be used to log in to your member account on the site by clicking on the “Member Log In” link.

You must not share the details of your account or password with anyone.  You are responsible for all use of such details and all use of your account.  You must tell us immediately of any unauthorised use that comes to your attention. We may suspend or terminate your account if it appears to us that you are, or your account has been used, in breach of these terms (including by providing false registration details or other misuse of the site). 
You must not attempt to interfere with the proper working of the site.

Intellectual Property Rights

All rights (including copyright) in the content of the site, certificates issued by us, and all systems used to support the scheme, are owned, licensed to or controlled by us and, unless we agree otherwise in writing, will remain our property. Your use of the site does not imply any licence to use the content in any way, or that a transfer of ownership has taken place. If any new rights are created through the use of the site, we will own them too. We may ask you to sign a document confirming this.

Your Information

We are committed to protecting your privacy and to complying with the terms of the Data Protection Act 1998. This section explains our data processing practices and how we use the data we collect.
We may collect and use the following information about you:

  • information you provide to us by registering with us, entering details on the site, or requesting a certificate;
  • information you provide when you contact us;
  • details of your visits to our site, including, traffic data, access to download data, location data, weblogs and other communication data.

We will take all reasonable steps to ensure that your information is treated securely and will never sell or rent such data to third parties. We will only use the information we collect to operate and promote the scheme and (unless you have asked us not to do so) to promote similar schemes to you that we believe may be of interest to you.

We will keep hold of your information for as long as we consider necessary.  If you wish us to stop using your information, you will need to cancel your membership by contacting us.

You have the right to access the personal information that we hold about you.  To obtain a copy of this information, please write to us enclosing your postal details and a cheque payable to ‘Renewable Energy Assurance Limited’ for £10 (this fee is to meet our costs of providing the information to you).  We may ask you to provide identification to us before we release the information to you.

Security

Transmission of information over the internet is not completely secure. We will do our best to protect your information but we cannot guarantee the security of transmissions to the site; and any transmission is at your own risk. Once we have received your information, we will use security procedures to try to prevent unauthorised access.

Links to Other Sites

These terms only concern our site at www.greengas.org.uk. We are not responsible for the practices of other websites that may be linked to from our site. These other websites should have their own privacy policies explaining how they will collect and use your information, and track your usage - we recommend that you check these policies.

No Warranty

In operating the scheme, we rely upon the information provided to us. We cannot be sure that such information is correct, so we cannot (and do not) represent, warrant or guarantee that the information accessible via the site or contained in any certificate is wholly accurate, complete or up-to-date. To the fullest extent permitted by law, we shall not be liable for any errors, omissions, misstatements or mistakes in the information contained on this site or a certificate, or any damages resulting from the use of such information, or any decision made (or action taken) in reliance on such information. Other than in the case of death or personal injury due to our negligence, or where we have acted fraudulently, we will not be responsible to you for any losses which you may suffer relating to the site or other information that we provide to you in connection with the scheme.

We do not warrant that the site will remain available at all times nor that the functions used or materials accessible or downloaded from the site will be uninterrupted or free of errors, viruses or other harmful components. You are responsible for taking appropriate steps to prevent any loss relating to such occurrences. Some times, we will have to withdraw, suspend or modify the site or parts of the site and there may be times when the site or certain parts of the site will be unavailable on an unscheduled basis.  In such circumstances, we will not be liable to you for any withdrawal, modification, unavailability, suspension or discontinuance of the site or any service available on or through the site.

Governing Law and Jurisdictional Issues

English law applies to these terms.  Any dispute arising out of or in connection with these terms and/or the use of the site will only be dealt with by the English courts, unless you are resident in another part of the United Kingdom, in which case the applicable law of that part of the United Kingdom will apply and any dispute will be brought before the courts there.

General

Any failure, or delay by us in exercising any right or remedy under these terms shall not prevent us from being able to enforce that, or any other, right or remedy at a later time. 

If anything in these terms is held to be invalid or unenforceable by any court or other competent authority, all other provisions will remain in full force and effect.

We may transfer any of our rights and/or transfer, sub-contract or delegate any of our responsibilities under these terms.  Where we do so, we will take steps to ensure that it does not affect your ability to rely on your rights. 
These terms are personal to you and are entered into by you for your own benefit and not for the benefit of any third party. You may only transfer or assign your rights under these terms with our prior consent (which we will not unreasonably refuse).

We may change these terms from time to time.  When we do so, we will provide access to the new terms at www.greengas.org.uk/scheme/disclaimer. The new terms will take effect immediately, and govern all use of the site.  If you do not agree with a new version of the terms, you must cease to use the site.
